The CAN-SPAM Act: How New Legislation Will Impact Nonprofit Email Communications and What to Expect in 2004

Overview Effective January 1, 2004, the legal ground rules governing spam in the United States have changed. The CAN-SPAM Act preempts stricter state laws regulating spam and legitimizes sending unsolicited commercial email, as long as the message is not fraudulent or pornographic, or message includes a valid address for the sender and a commercial label, and enables recipients to opt-out of further communications.
