Music Licensing: Legal Developments for the Independent Label
Overview This article will address the practical considerations of a music copyright owner who wants to take advantage of the Internet under the auspices of an "independent label." Clearly, the law is becoming favorable to the IMCO, despite problems with public performance rights. Licensing alternatives offer more choice and flexibility, especially over the Internet. What remains is putting these laws into practical use. Establishing and enforcing copyright licenses over the next few years is of immediate concern to everyone in the entertainment industry as well as any intellectual property based product or industry. IMCOs will help establish the contractual and legal precedents needed to encourage music availability over the Internet. If handled properly, online contracts and licensing promise to be lucrative for the copyright owners and rewarding to music lovers.
